Kangana Ranaut will be defeated in Javed Akhtar contempt case

A Mumbai sessions court on Wednesday rejected two petitions filed by Bollywood actress Kangana Ranaut seeking transfer of proceedings between her and lyricist Javed Akhtar from Andheri Magistrate to another magistrate. Was

 Additional Sessions Judge SM Bhosle today ruled on two petitions filed by Ranaut.

One petition sought transfer of the defamation suit filed by Javed Akhtar against Sarnavat, while the other petition sought transfer of his cross-complaint alleging extortion against Javed Akhtar. ۔

Ranawat had approached the Chief Metropolitan Magistrate of Esplanade and requested that the two complaints be transferred from the court of Metropolitan Magistrate RR Khan to another Metropolitan Magistrate.

 The Espland Magistrate rejected both transfer requests.

Ranawat then moved the Sessions Court in Dandoshi seeking special jurisdiction under Section 408 of the Criminal Code.

He claimed in his petition that the magistrate of Andheri had deliberately misused his powers to injure him.

Kangana Ranaut said the Andheri magistrate had tarnished her image by announcing in an open court in front of the media that an arrest warrant would be issued against her if she did not appear in court on the next date.

It states that if a magistrate was willing to issue a warrant, he or she should have issued an appropriate order stating the reasons for doing so.

The petition also states that Espland CMMST Dande had sought comments from Andheri Magistrate on Ranawat's application, but it was never recorded on the ground that it was confidential.

Ranawat argued that such comments do not fall into the category of confidential information or privileged information as they not only affect Ranawat's legitimate rights but also the manner in which the case is decided.

Javed Akhtar, through his lawyer JK Bhardwaj, said that Ranawat had on five occasions unsuccessfully challenged the procedure adopted by Magistrate Khan and this was his sixth challenge to the present application process.

 He argued that the Andheri Magistrate had allowed his seven petitions to be excused from personal appearance.

Altogether, Ranawat did not appear on the 12 dates when the case was registered and was summoned for the limited purpose of filing a petition to file charges under the Criminal Code.

He alleged that Ranawat was trying to delay the proceedings due to which his application could not be registered.
